    Why Do Medical Students Need Lawyers?

    The lives of medical students are difficult, but that’s not all about the studies. Therefore, medical students also can benefit from the services of a lawyer. Just as a medical student is responsible for her own education, she should be equally responsible for her own legal matters. Having a lawyer for medical students can help them ease the pressures and concerns of operating in both the educational and professional worlds simultaneously.

    Let us explore why medical students need lawyers and when they should hire attorneys.

    • Academic misconduct

    Medical students can be charged with academic misconduct, which is a broad term that includes plagiarism, cheating on exams and laboratory work, falsifying research data, and falsifying progress reports and other internal documents relating to the school.

    So, what does it mean for a medical student to be charged with academic misconduct? First of all, being formally charged can lead to suspension or expulsion from the school. A lawyer might become necessary to protect their right to continue with the medical degree, and ensure the medical school does not take unfair action against the student.

    • Title IX

    Title IX is the federal civil rights law that prohibits discrimination based on sex in education programs that receive federal financial assistance. Under Title IX, no person may be excluded from participation, be denied the benefits of, or be subjected to discrimination based on their gender. Title IX applies to all aspects of medical school operations and activities, including admissions, classroom experience, housing, medical training, and research opportunities.

    • Disciplinary charges

    Medical students can face disciplinary charges as well. Examples of disciplinary charges include behavior that violates the school’s code of conduct, poor medical or clinical judgment, and drug or alcohol use on or off the medical campus. Medical students might be prosecuted for violations of medical school rules, so legal counsel can help to ensure the school’s version is accurate, and provide witnesses to back up those assertions.

    • Academic issues

    Students can have academic issues that require a lawyer’s help. The common academic issues among medical students involve disputes about grades and evaluations, disputes with professors regarding class scheduling or research time, or issues involving the school’s decision to deny a request for a leave of absence. 

    • Dismissals

    Students can be dismissed for failing to meet academic or clinical standards. They may be placed on probation, required to withdraw from the school, or suspended from the clinical program. During these times, a lawyer might become necessary to protect their right to continue with the medical degree and ensure the medical school does not take any hasty action against the student.
