    The First Police Interview Can Shape the Entire Criminal Case

    People are often most willing to speak at the moment when they know the least. A police officer calls, says that a few questions will clear up a misunderstanding, and asks the person to attend that afternoon. The invitation sounds informal. The resulting statement may become one of the most important documents in the case.

    The sensible first question is not “What should I say?” It is “In what legal capacity am I being asked to speak?” An accused person, a witness and someone providing information do not stand in the same procedural position. The label used on the telephone may also differ from the status shown in the formal record.

    Clarify status before discussing facts

    Ask for the investigator’s name, authority, case reference, proposed time and whether a written summons exists. Find out whether attendance is compulsory and whether the person is considered a witness or accused. If the answer is unclear, a lawyer can contact the investigator without turning that contact into a factual interview.

    Status affects silence, self-incrimination, legal representation and the consequences of refusal. It can also change during an interview. A person invited as a witness may give an answer that shifts suspicion toward them. Counsel should be alert to that possibility before the interview begins, not after a transcript is signed.

    Accuracy is more important than speed

    An interview is not a memory contest. Dates, amounts, names and sequences should not be guessed simply because silence feels uncomfortable. If a document is needed to answer accurately, say so. If a question contains an incorrect premise, correct the premise before answering it. A short accurate answer is safer than a long theory assembled under pressure.

    Complete context matters. An investigator may show one message from a long conversation or ask about a payment without the underlying contract. The person should not assume that the missing information is already understood. At the same time, the interview is not an opportunity to deliver every document and argument in the case without a considered plan.

    Interpretation must be effective

    Legal vocabulary is difficult even for people who manage daily conversation in Georgian. A participant with insufficient command of the proceedings language should request an interpreter in the language and dialect they understand best. Informal summaries are not enough for a rights warning, technical allegation or contested statement.

    Objections to incomplete or inaccurate interpretation should be made at once and recorded. Never sign a Georgian document because someone says it is “basically correct.” Read the whole record through proper interpretation, compare it with what was actually said and require corrections before signing.

    The written record outlives the room

    The tone of a conversation disappears. The transcript remains. It should accurately identify who was present, the person’s status, the rights explained, the questions and answers, breaks, interpreter and any documents or recordings used. If the interview was audio- or video-recorded, note that fact and preserve the route for obtaining it.

    Anyone reviewing rights during police questioning in Georgia should also consider what happened before the formal recording started. Waiting-room exchanges, transport conversations and “background” questions may later be described as voluntary statements. The chronology should begin with first contact, not with the first typed line of the interview.

    What not to do after the interview

    Do not contact other witnesses to align memories. Do not delete messages, edit files or create a replacement document. Do not post an explanation online. Preserve the material in its original form and give counsel a factual note while the sequence is fresh.

    A lawyer’s presence is not an admission of wrongdoing. It is a way to ensure that status, language, rights and the record are controlled before an answer becomes permanent evidence. The best interviews are rarely dramatic. They are careful, comprehensible and limited to what the person can truthfully and accurately address.
