When a driver chooses to operate a vehicle while seriously impaired by alcohol or drugs, the resulting collision can cause devastating injuries or death. Depending on the circumstances, damages can include categories such as loss of financial support, loss of companionship, funeral and burial expenses, and other legally recoverable losses.
A separate survival action may also be available in appropriate circumstances. The claims and damages available depend on the facts, the decedent’s circumstances, and California’s procedural and substantive requirements.
Insurance Does Not End the Analysis
A common mistake is assuming that the existence of automobile insurance determines the full value or scope of a claim. Insurance coverage, policy limits, exclusions, additional insureds, and other coverage issues can become important in serious DUI cases.
Punitive damages also require separate legal analysis because insurance coverage for punitive damages can depend on applicable California law, the policy language, and the circumstances of the claim.
Why Early Investigation Matters
